Anti 'Instant Racing' Group Gains Ground

A Kentucky judge has ruled that the Family Foundation of Kentucky will be able to intervene in a 'friendly' lawsuit which will test the legality of Instant Racing at

state racetracks.

According to a report on wfpl.org, Franklin Circuit Judge Thomas Wingate said that the group will be able to challenge what it considers an unconstitutional form of gambling.

Instant racing involves electronic, slot-machine-style wagering on previously-run horse races, referred to in this case as 'historical races.'

“If you look at the common definitions of pari-mutuel racing, which are used all across this country, they involve certain pools and the bettors having a role in setting odds," Judge Wingate was quoted as saying in the wfpl.org report.

"And there’s all kinds of questions like that which bear on whether or not Instant Racing is really pari-mutuel wagering, which is really the central issue of this case."
