The Ontario Racing Commission today released its ruling in regard to the Appeal and Request for Hearing by horse owner Jeffrey Snyder in relation to the redistribution of purse monies earned by Michelles Power
.

Standardbred licensee Jeffrey Snyder properly appealed Ruling SB 99/2008, wherein the Director ordered that any purse monies earned by the horse MICHELLES POWER, from August 29, 2007 until November 24, 2007, be remitted to the association within fifteen days for redistribution, and imposing a period of ineligibility retroactively for the same period. On July 9, 2008, Ruling SB 99/2008 was stayed by order of the Deputy Director pursuant to Ruling GEN 001/2008.
On December 15, 2010, a Commission Panel composed of Chair Rod Seiling, sitting alone, convened a hearing. Brendan van Niejenhuis appeared as counsel to the Administration and Arlen Sternberg appeared as counsel to Jeffrey Snyder.
On being advised that the parties consented to an order allowing the appeal, and that the Administration would call no evidence, and on hearing the submissions of counsel for the parties, the Commission allowed the appeal and set aside Ruling SB99/2008. Written reasons for decision were prepared by the Panel, a copy of which is attached to this Ruling.

Well the rules are the rules
Well the rules are the rules but I think when they were created, these kind of drugs and situations were non-existent.
However remains to see if the ORC will do changes to prevent this from happening again. You're talking about a sample that was re-tested 8 months after collection due to a new detection test. Lets not forget that Mr. Elliott did train till May also.
Horse races. Horse wins
Horse races. Horse wins purse money. Horse gets tested. Horse test returns positive. Trainer gets suspended. Owner returns money. Oh wait, the owner gets to keep the money his horse received on a positive test. UNBELIEVABLE!! All trainers and owners should take note. This should be precadent setting. When your trainer receives a positive test, the owner does not have to return the purse money. What's next? Is the ORC going to tell the betting public that horses are now allowed to race with drugs and whatever else in their system? Oh wait again, the betting public wasn't fortunate enough to know that this horse raced with some kind of pre-race in his system. And the ORC doesn't understand why people are leaving in droves, and new people are not interested in getting into the business.

Does this seem a bit like the O J Simpson trial ? We have the Positive test, the convicted trainer and the rich and famous owner who walks away with his $300 plus grand. If this had been a small time owner, a guy with no previous convictions and he was the owner of a horse that tested positive he wouldn't stand a chance of winning an appeal such as this. Nice double standard ORC, this should really promote horse racing.

Its is very disturbing to see that the old boys club is still alive and prospering. It seems that if you can afford to hire a topnotch lawyer you can do what ever you want .
I am pretty sure one of the words most often used by our governing body was they are responsible for the INTEGRITY of horse racing. This decision has destroyed the meaning of that word. I have tryed not to make any negative comments on this site but i could not help myself on this one.

Everything and everyone related in someway or another to Bill Robinson,to whom as a race fan have cashed numerous winning tickets,are going down lately.But he got away with it for so many,many years. The bettor loves betting on a winner but this is disgracefull.
Yet again, another decision
Yet again, another decision from the ORC just proves that if you have money, you also have your own set of rules. The horse tests positive, the trainer is suspended and fined but yet the Billionaire owner, who suffered such a financial loss gets off scott free. What about the rest of us that weren't racing on EPO, what about our financial loss. ANOTHER GREAT JOB BY THE ORC. What a joke.
