ORC Rules On Three Appeals

The Ontario Racing Commission has released its rulings in regard to the appeals of Dr. Christina Lynne Blackburn, Alan Wallace and Dave Wall and Ervin Abdulov

In regard to the appeal of Dr. Blackburn… on March 11, 2010, the judges issued Standardbred Official Ruling SB 41427 wherein Dr. Blackburn was given the penalty of six months probation for violation of Standardbred Rule 1.09.

On March 21, 2010, Blackburn filed a Notice of Appeal, pursuant to Rule 24.01(b) of the Rules of Standardbred Racing. On May 5, 2010, a panel of the ORC, comprised of commissioner John Macdonald, convened for the purpose of hearing this matter. Tom Miller appeared on behalf of the administration of the ORC. Blackburn attended the hearing and was represented by Larry Todd.

After reviewing the evidence, hearing the testimony of judge Pat Webb, and upon considering the closing submissions, the panel allowed the appeal. Therefore Ruling SB 41427 is rescinded and the probation is quashed.

In regard to the appeal of Alan Wallace… on March 13, 2010, the judges issued Standardbred Official Ruling SB 41938 wherein Wallace was given the penalty of a three-day driving suspension and the horse, Baskin Babe, was placed from third to ninth for the violation of Standardbred Rule 22.05.01(a) in Race 8 at Flamboro Downs on March 4, 2010.

On March 15, 2010, Wallace filed a Notice of Appeal, pursuant to Rule 24.01(b) of the Rules of Standardbred Racing. On May 5, 2010, a panel of the ORC, comprised of commissioner John Macdonald, convened for the purpose of hearing this matter. Tom Miller appeared on behalf of the administration of the ORC. Wallace attended the hearing and was represented by Brian Tropea.

After reviewing the evidence, and upon hearing the testimony of judge Larry Hughes, and upon considering the closing submissions, the panel disallowed the appeal and upheld the decision of the judges. Wallace will serve the three-day driving suspension on May 8, 9 and 10, 2010, inclusive.

In regard to the appeal of Dave Wall and Ervin Abdulov… on April 6, 2010, the judges issued Standardbred Official Rulings SB 42316 wherein Wall was given the penalty of a $300 fine, and SB 42315 wherein the horse Twin B Brat was placed from first to fifth for violation of Standardbred Rule 18.08.02 in Race 9 at Western Fair Raceway on March 30, 2010.

On April 6, 2010, Wall and Abdulov filed notices of appeal, pursuant to Rule 24.01(b) of the Rules of Standardbred Racing.

On May 5, 2010, a panel of the ORC, comprised of commissioner John Macdonald, convened for the purpose of hearing this matter. Tom Miller appeared on behalf of the administration of the ORC. Wall and Abdulov attended the hearing and were unrepresented.

After reviewing the evidence, hearing the testimony of judge Jeff Minler, and upon considering the closing submissions, the panel allowed the appeal. The fine of $300 is rescinded, the placing is quashed and the horse is reinstated to the first finishing position.
