The Superior Court of Ontario has released its judgment in regard to the situation which came to light in August, 2009 relating to standardbred owner/horseman Isaac Waxman, agent Ken Hornick, owner/trainer John Wagner, owner James Coughlin and agent Marc Reynolds
in regard to the sale of the racehorse Boss Outlaw.
In a claim filed in court on July 28, 2009, Waxman claims:
- Damages jointly and severally from the defendants for negligence, negligent misrepresentation, breach of contract, and breach of warranty in the amount of $50,000;
- Pre and post judgment interest pursuant to Section 127 of the Courts of Justice Act, R.S.O. 1990, c.C. 43;
- Costs on a substantial indemnity scale, and;
Such other relief as counsel may request and the honourable court seems fit to grant.
Waxman claimed that Boss Outlaw was injured when it came into his possession on May 9, 2009.
The Superior Court of Ontario's judgment states that:
- 1) The court orders and adjudges that Marc Reynolds shall pay $50,000 to the Plaintiff Isaac Waxman, and;
- 2) The court further orders and adjudges that Marc Reynolds shall pay $1,800 pre-judgment interest to the Plaintiff Isaac Waxman and;
- 3) The court further orders and adjudges that Marc Reynolds shall pay $1,096 for the costs and disbursements of the action against him and motion to the Plaintiff Isaac Waxman.
The judgment for $51,800 and the costs of $1,096 each bears post judgment interest at the rate of 2% per year from its date.
