Joseph Bernstein, who walked away with a $7 million settlement when ousted as CEO last year, now threatens “a billion dollar class action lawsuit” indirectly involving Genting Malaysia, parent of the winner of the
Aqueduct racino contract.
Bernstein says two Empire directors, Michael 'Mickey' Brown and Au Fook Yew, also known as Colin Au, conspired with Kien Huat Realty, a Genting operation, in helping Genting win the New York franchise.
Bernstein wrote to Au, saying they would bury Empire’s stock through their actions, and end up with years of class action lawsuits.
Bernstein's solution? Brown and Au should resign as directors and let Bernstein and Louis Cappelli, known for his efforts with Concord, take over Monticello and become Genting participants at Aqueduct.
