The Kentucky Supreme Court has denied a motion filed to review a decision by a Kentucky Court of Appeals involving Loyal Opposition's positive in the final of the 2005 Allerage Mare Pace at the Red Mile.

Loyal Opposition, owned at the time by Daniel Waxman, won the $80,000 race, but subsequently tested positive for Flunixin. The mare's trainer, Erv Miller, paid the $250 fine, but Waxman appealed the ruling, which called for the return of the $40,000 winner's cheque, which had been issued.

Waxman has argued the case through the Kentucky courts, but has now been denied at the highest level.
