The Kentucky Supreme Court has denied a motion filed to review a decision by a Kentucky Court of Appeals involving Loyal Opposition's positive in the final of the 2005 Allerage Mare Pace at the Red Mile
.
Loyal Opposition, owned at the time by Daniel Waxman, won the $80,000 race, but subsequently tested positive for Flunixin. The mare's trainer, Erv Miller, paid the $250 fine, but Waxman appealed the ruling, which called for the return of the $40,000 winner's cheque, which had been issued.
Waxman has argued the case through the Kentucky courts, but has now been denied at the highest level.
