Citing the fact that many races are contested in the afternoons, five of the off-track wagering organizations which operate in New York State have indicated that they want an adjustment to the payments they are forced to make to NY harness tracks

.

According to courthousenews.com, OTW corps complained that despite having issued a letter which highlighted the fact that 'maintenance of effort' (MOE) payments should be ended for the dates that tracks contested races before 6:oo p.m. ('protected nighttime hours'), subsidies were kept in place and the board "gave no rationale or explanation for its determination in this regard."

The tracks named in regard to the situation are Buffalo Raceway, Monticello Raceway, Saratoga Raceway, Tioga Downs, Vernon Downs and Yonkers Raceway.
