Trot Insider has learned that on Friday, December 18, the Supreme Court of Canada released its decision in regard to horseman Derek Riesberry’s appeal of fraud convictions.
The court upheld Riesberry’s conviction on two counts of fraud, but it also sent another key issue back to trial.
The December 18 ruling opens the door for another trial to determine whether horse racing is ‘a game of chance or mixed chance and skill,’ and, thus, whether Riesberry’s conduct constituted ‘cheating at play.’
