A report yesterday by the New York Daily News states that an attorney representing harness driver Walter Case, Jr. has filed a motion for judicial release for his incarcerated client.
"The judge will listen to evidence that we will provide and hopefully will release (Case) early," Whitney was quoted as saying in the report.
Case has served four years of a five-year sentence for felonious assault after stabbing his then-estranged wife Nadine in the back with a steak knife.
Regardless of the court's ruling on the motion, Case is eligible for parole early next spring.
