Riesberry Appealing To Top Court
It has been reported that trainer Derek Riesberry will be appealing his fraud conviction to the Supreme Court of Canada.
News of Riesberry’s appeal comes courtesy of an article by The Windsor Star.
In the report, Riesberry’s lawyer, Andrew Bradie, has been cited as saying that he believes that it could take up to two years until the Supreme Court of Canada hears the appeal.
The article has quoted Bradie as saying that Riesberry is not planning on returning to the industry.
In late October, the Ontario Court of Appeal released a decision which stated that Riesberry had been found guilty of fraud. He had been acquitted of the fraud charges last year by Superior Court Justice Steven Rogin, even though Rogin determined in his ruling that Riesberry was a ‘cheat.’ In the ruling, Rogin determined that the Crown did not prove that the trainer technically defrauded the public.
The Ontario Court of Appeal’s recent decision determined that Rogin ‘erred’ in his decision. The appeals court has now sent the case back to Rogin in order for him to sentence Riesberry on the fraud charge.
