ORC Releases Three Rulings

On Monday, June 17, the Ontario Racing Commission released its rulings on appeals from licensees Frank Hincks, Georg Leber and Jamie Wilson.

In regard to Hincks, he was appealing SB Ruling Numbers 45050 and 44419, issued on May 1, 2013, wherein he was suspended for 60 days and fined $1,500 and put on probation for two years for violating SB Rules 9.09 (b), 26.02.01 and 26.02.02. The appeal was for the penalty portion of the Ruling.

After carefully listening to the testimony and reviewing the evidence and documents filed, the ORC Panel denied the appeal but varied the penalty. The remainder of Hincks’ suspension is stayed effective with the release of this decision. All other aspects of the Rulings SB 44050 and 44419 remain in effect. Should he incur a positive test while under probation, the stay will automatically expire.

In regard to Leber, he was appealing SB Ruling Number 45827. The ruling was issued on April 29, 2013, suspending the horse, Rubis Prescott, for 90 days, April 29, 2013 to July 27, 2013, as a result of a positive TCO2 test from the horse racing in Race 4 at Woodbine Racetrack on April 25, 2013. The hearing was on penalty only.

After carefully listening to the testimony and reviewing the evidence and documents filed, the ORC Panel denied the appeal.

In regard to Wilson, the ORC was only sending out an amended ruling. Wilson's appeal was in regard to multiple rulings that were issued on March 27, 2013 that had to do with the horses East Meadow, Abigail Eden and Wedding Bell Blues.
