Cappelli Wins Latest Battle In NYS

A lawsuit filed by the owners of Monticello Raceway against the Town of Thompson in regard to allegations of the illegal issuing of building permits to prospective racino developer Louis Cappelli have been thrown out

by judge Frank LaBuda, according to a report.

A report by the Times Herald-Record explains that Monticello Raceway's parent company, Empire Resorts, had taken the position that Cappelli's project for a racino/conference centre had substantially changed and an additional study was needed.

The suit had stated that the town violated environment and town law and procedural agreements in granting building and permit extensions.
