Suit Against State Of Kentucky Thrown Out

A Kentucky judge has thrown out a suit filed against the state which claimed the state breached a contract with developers of a proposed hotel at the Kentucky Horse Park

.

A report by the Lexington Herald-Leader states that the suit filed by Bluegrass Equine and Tourism Foundation was dismissed by Franklin Circuit Court Judge Phillip Shepherd.

The article explains that the state terminated the hotel contract in 2008 because financing had not been secured.

Shepherd wrote, "By any reasonable interpretation of this agreement, the failure to obtain financing by April 15, 2008, was unacceptable, and the Commonwealth had every right to protect its interest in ensuring that the operation of the Kentucky Horse Park was not impaired by an uncompleted major construction project during the WEG (the 2010 Alltech FEI World Equestrian Games)."
