Commission Allows McCabe Appeal

On Friday, August 14, the Ontario Racing Commission released its ruling in regard to the appeal and request for hearing of horseman Andrew McCabe.

McCabe had appealed Rulings Number SB 46422 and SB 45087, which had been issued to him for violation of Rules 9.09 (a) & (b), 26.02.01 and 26.02.02 of the Rules of Standardbred Racing, for a positive test result from the horse Stompin Tom Creek, which raced at Kawartha Downs on July 12, 2014.

The ORC panel that heard the appeal allowed the appeal. Thus, SB Ruling 46422 and SB Ruling 45087 dated June 19, 2015 have been set aside. Additionally, the Certificate of Positive Analysis dated July 22, 2014 has been set aside. The purse is to be distributed according to the original placement on July 12, 2014, with Stompin Tom Creek receiving first-place purse earnings.
