Ontario Commission Rules On Appeals

On Monday, July 21, the Ontario Racing Commission released rulings and decisions in regard to appeals by licencees Colin Johnson, Yves Tessier, David Edwards, and Gabriella Sasso and Ronald Adams.

Colin Johnson had requested a hearing against two decisions made by the executive director of the ORC pursuant to sections 22 and 23 of the Racing Commission Act (1 – Notice of Immediate Suspension; and 2 – Notice of Proposed Order of Suspension). In its decision, the panel ruled that the immediate suspension, as it applies to Colin Johnson, is vacated and the application for the Notice of Proposed Order is dismissed.

Yves Tessier had appealed against an Order of Immediate Suspension and a Notice of Proposed Order which had been issued against him by the director of the ORC. In its decision, the ORC ruled that, on consent, an Order is to go as set out in the joint proposal in a July 16, 2014 letter of Counsel for the Administration: 1) Mr. Tessier to withdraw his appeal; 2) No costs shall be imposed for the appeal withdrawal; 3) Quash the Immediate Suspension of Yves Tessier; 4) Vacate the director’s Proposed Order issued to Tessier.

David Edwards had applied for the reinstatement of his licence, which was suspended by Ruling Number SB 77/2012 (dated June 29, 2012) for violation of a Post Violation Agreement. The ORC panel denied the application.

Gabriella Sasso and Ronald Adams had appealed against: (i) Rulings which placed holds on purse monies made on February 7, 2014, by the Track Judges; (ii) Orders of Immediate Suspension made on May 20, 2014, by the director of the ORC; and the (iii) Notices of Proposed Orders of Suspension made on May 20, 2014, by the director of the ORC. On June 6 and 9, 2014, the appellants made an application for the following: (i) Stays of the Orders of Immediate Suspension; and (ii) Stays of the holds on purse monies. The ORC panel that heard the appeal decided: (i) The applications for stays of the Orders of Immediate Suspension were denied; and (ii) the applications for stays of the holds on purse monies were denied. The hearing of the Notices of Proposed Orders is set for July 21 and 22, 2014.
